Welcome to ManoGati! These Terms of Service ("Terms") govern your use of our mobile and web applications (collectively, the "Platform"). By accessing or using ManoGati, you agree to these Terms. Please read them carefully before using our services.
1. About ManoGati
ManoGati provides a digital platform that connects individuals ("Users") with wellness professionals ("Wellness Partners"), such as therapists, counselors, and coaches. The Platform facilitates scheduling, communication, payments, and session management.
Important: ManoGati itself does not provide medical, psychiatric, or therapeutic services. All services are provided by independent Wellness Partners.
2. Eligibility
You must be at least 18 years old to use the Platform. If you are under 18, you may only use the Platform with the consent and supervision of a parent or legal guardian.
By using the Platform, you confirm that all information you provide is accurate, truthful, and up to date.
3. Nature of Services & Disclaimer
ManoGati is not a healthcare provider and does not provide medical or psychiatric diagnoses, prescriptions, or emergency services. Wellness Partners are independent professionals and solely responsible for the advice or services they provide. ManoGati does not endorse or guarantee any outcomes.
If you are experiencing a medical emergency or suicidal thoughts, please contact local emergency services or a crisis hotline immediately.
Users are encouraged to verify the credentials of Wellness Partners before engaging their services.
4. User Responsibilities
By using the Platform, you agree to:
- Provide accurate registration and payment details.
- Use the Platform only for lawful purposes.
- Maintain confidentiality of consultations and communications.
- Not upload or share unlawful, offensive, or copyrighted content without proper authorization.
- Not misuse the Platform for harassment, abuse, impersonation, or fraudulent purposes.
5. Payments & Refunds
Fees for sessions, packages, or subscriptions (if applicable) will be displayed before purchase. Payments are processed through secure third-party gateways. ManoGati is not responsible for failures of such services.
Refunds, if applicable, will be governed by our Refund Policy [To be launched soon]. Any applicable taxes will be charged as per law.
6. Intellectual Property
All content, logos, trademarks, software, designs, and technology on the Platform are owned by or licensed to ManoGati. Users may not copy, modify, reverse engineer, or distribute Platform content without prior written consent.
7. Privacy & Data Protection
Your use of the Platform is also governed by our Privacy Policy. ManoGati implements reasonable technical and organizational safeguards to protect your data in compliance with applicable laws (including the Indian IT Act, 2000 and GDPR where applicable).
8. Limitation of Liability
ManoGati is not responsible for any injury, loss, or damages resulting from the use of the Platform or reliance on professional advice. To the fullest extent permitted by law, ManoGati disclaims all warranties, express or implied, including availability, accuracy, and fitness for purpose.
Cap on Liability: In no event shall ManoGati's total liability exceed the total fees paid by the User in the three (3) months preceding the claim.
9. Indemnity
Users agree to indemnify, defend, and hold harmless ManoGati, its affiliates, officers, and employees from any claims, damages, liabilities, or expenses arising from misuse of the Platform, violation of these Terms, or infringement of third-party rights.
10. Third-Party Services
The Platform may integrate with third-party services (e.g., video conferencing, payment gateways, cloud hosting). Use of such services is at your own risk and governed by the terms and privacy policies of those providers. ManoGati is not liable for failures or misuse of such third-party services.
11. Termination of Use
We may suspend or terminate your account, with or without notice, if you:
- Violate these Terms,
- Misuse the Platform, or
- Engage in unlawful or harmful activity.
Upon termination, your right to use the Platform ceases immediately.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Gujarat, India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Vadodara, Gujarat, India.
Before court proceedings, the parties agree to first attempt mediation/arbitration in good faith.
13. Force Majeure
ManoGati shall not be liable for delays or failures due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, or internet outages.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain valid and enforceable.
15. Changes to Terms
We may update these Terms periodically. Continued use of the Platform after updates indicates acceptance of the revised Terms.
